Ethics Board Docket No. 2014-1278 <br /> Page 8 of 10 <br /> VII. ORDER <br /> In light of the lengthy litigation involved in this matter, including the conflicting judgments <br /> from the EAB and the 19"Judicial District Court as to the Respondents' status as a public servant, <br /> as well as the possible need for additional hearings, and the genuine dispute between the parties as <br /> to the substance of this matter, the parties have agreed to resolve this matter amicably. Therefore, <br /> it is the conclusion of the BOE that the interests of the public and judicial efficiency would be <br /> served through the publication of this Consent Opinion without the imposition of any civil penalty. <br /> It is further the conclusion of the Respondent that, while they believe their claims and defenses <br /> against the BOE in the 19th Judicial District Court and the EAB are meritorious and they would <br /> ultimately prevail, resolving this matter is best for all Parties and for the Respondent's business. <br /> For the foregoing reasons: <br /> IT IS ORDERED that Charges pending against the Respondents before the EAB in <br /> Docket No. 2015-14943-ETHICS-B shall be dismissed accordingly upon adoption of this Consent <br /> Opinion. <br /> IT IS FURTHER ORDERED that Respondents shall dismiss all matters pending before <br /> the 19th Judicial District Court and that Respondents shall pay all outstanding court costs associated <br /> with Docket No. 648379. <br />
