Ethics Board No. 2023-887 <br /> Page 4 of 8 <br /> 1. <br /> Section 1505.2I(1) of the CFDA provides that contributions received by a candidate may <br /> not be expended for any personal use unrelated to a political campaign. Section 1505.21(l) of the <br /> CFDA provides in pertinent part: <br /> §1505.2. Contributions; expenditures; certain prohibitions and limitations <br /> 1.(1) On and after January 1, 1991, contributions received by a candidate or a <br /> political committee may be expended for any lawful purpose, but such funds shall <br /> not be used, loaned, or pledged by any person for any personal use unrelated to a <br /> political campaign, the holding of a public office or party position, or, in the case <br /> of a political committee, other than a candidate's principal campaign committee or <br /> subsidiary committee,the administrative costs or operating expenses of the political <br /> committee; .... <br /> 2. <br /> The following terms are defined in Section 1483 of the CFDA and are relevant when <br /> analyzing the above Sections: <br /> (3)(a) "Candidate" means a person who seeks nomination or election to public <br /> office, except the office of president or vice president of the United States, <br /> presidential elector, delegate to a political party convention, United States senator, <br /> United States congressman, or political party office. <br /> (6)(a) "Contribution", except as otherwise provided in this Chapter, means a gift, <br /> conveyance, payment, or deposit of money or anything of value, or the forgiveness <br /> of a loan or of a debt, made for the purpose of supporting, opposing, or otherwise <br /> influencing the nomination or election of a person to public office, for the purpose <br /> of supporting or opposing a proposition or question submitted to the voters, or for <br /> the purpose of supporting or opposing the recall of a public officer, whether made <br /> before or after the election. <br /> (9)(a) "Expenditure" means a purchase, payment, advance, deposit, or gift, of <br /> money or anything of value made for the purpose of supporting, opposing, or <br /> otherwise influencing the nomination or election of a person to public office, for <br /> the purpose of supporting or opposing a proposition or question submitted to the <br /> voters, or for the purpose of supporting or opposing the recall of a public officer, <br /> whether made before or after the election. <br />
