(iv) Under the supervision or authority of an elected official or another employee of the <br /> governmental entity. <br /> La. R.S. 42:1102(19) defines "public servant" means a public employee or an elected official. <br /> ANALYSIS <br /> As the former Assistant Chief of Technology in the SFM Special Services and Support Division, <br /> you were a public employee pursuant to La. R.S. 42:1102(18)(a) and a public servant pursuant to <br /> La. R.S. 42:1102(19). For purposes of the Code, your agency was the SFM Special Services and <br /> Support Division pursuant to La. R.S. 42:1102(2)(a), and your governmental entity was the State <br /> of Louisiana pursuant to La. R.S. 42:1102(12). You were not an agency head pursuant to La. R.S. <br /> 42:1102(3). <br /> La. R.S. 42:1121B(1) prohibits you, for two years following your retirement from public <br /> employment with the SFM in April 2024, from assisting another individual or legal entity, <br /> including DBS, its sister teclmology companies, or its clients, for compensation in a transaction, <br /> or in an appearance in connection with a transaction, in which you participated at any time during <br /> your public employment with SFM and involving the State of Louisiana. However, you are not <br /> prohibited from assisting DBS, its sister tecl�nology companies, or its clients for compensation on <br /> any matter involving the State of Louisiana in which you did not previously participate during <br /> your employment with SFM. <br /> , La. R.S. 42:1121B(1) also prohibits you, for two years following your retirement from public <br /> employment with the SFM in April 2024, from rendering any service, which you previously <br /> rendered to the SFM Special Services and Support Division during the term of your public <br /> employment, on a contractual basis to, for, or on behalf of your for�ner agency, the SFM Special <br /> Services and Support Division, regardless of the parties to the contract. However, you are not <br /> prohibited from rendering new services that you have not previously rendered to the SFM Special <br /> Seivices and Support Division during your public employment, on a contractual basis to, for, or <br /> on behalf of the SFM Special Services and Support Division. <br /> Additionally, La. R.S. 42:1121C prohibits DBS, for two years following your retirement from <br /> public employment, from assisting another individual or legal entity, such as a sister technology <br /> company or a client, for compensation in a transaction, or in an appearance in connection with a <br /> transaction, in which you at any time previously participated during your public employment and <br /> involving the SFM Special Services and Support Division. However, DBS is not prohibited from <br /> assisting another individual or legal entity for compensation in connection with a transaction <br /> involving the SFM Special Services and Support Division in which you did not previously <br /> participate during your employment with SFM. <br /> CONCLUSION <br /> The Board concluded and instructed ine to inform you that the post-employment restrictions <br /> contained in the Code, as explained in the above paragraphs, apply to you and DBS for two years <br /> following the date you retired from your public employment with the SFM in April 2024.
