-3- <br /> • upon the relationship between the supervisor and the particular <br /> employee. <br /> In the particular case which the Commission has considered, <br /> it received substantial and persuasive evidence that, with regards to <br /> this particular event, employees were instructed that their participation <br /> in this function was voluntary, and that the participation of most, if <br /> not all, of the employees in this function was voluntary. <br /> However, the Commission is issuing this advisory opinion in <br /> the hope that it will make agency heads and supervisors aware of the <br /> fact that the organization of functions such as this presents the <br /> potential for violations of the abuse of office section of the Code. While <br /> the Commission is not of the opinion that functions such as that <br /> described above necessarily will result in violations of the Code, it is of <br /> • the opinion that violations of the Code are likely to occur in such <br /> situations. The Commission will continue in the future to closely <br /> scrutinize such activities for violations of Section 1116 of the Code, and <br /> any information it discovers suggesting participation by employees is <br /> not completely voluntary will be acted on accordingly. <br /> s/ Robert C.
