Prudhomme Street <br /> Opelousas, LA 70570 <br /> RE: Ethics Board Docket No. 2010-903 <br /> Dear Ms. Lewis: <br /> The Louisiana Board of Ethics,at its October 15,2010 meeting,considered your request for <br /> an advisory opinion regarding whether you may accept employment as Executive Director <br /> of the Harvest Preparatory Academy after resigning from the Department of Education. You <br /> stated that you are currently employed with the Department of Education as an Educational <br /> • Program Consultant 2. As a consultant, you work with school counselors by assisting the <br /> counselors with professional development opportunities. You also work with the 9th grade <br /> initiative grant school program. The 9th grade initiative grant program provides grants for <br /> high schools to increase graduation rates by setting up 9th grade academies. <br /> The Outreach Community Development Corporation (OCDC)has begun the process of <br /> obtaining a Type Two, BESE approved charter school, Harvest Preparatory Academy. You <br /> have assisted the OCDC with the application process and would like to serve as the <br /> Executive Director of the Harvest Preparatory Academy. The Academy will begin with <br /> grades 5-7 and will increase one grade level every year until the 12th grade.The opening date <br /> is July 2011. <br /> The Board concluded,and instructed me to advise you,that the Code of Governmental Ethics <br /> would not prohibit your employment as Executive Director of the Harvest Preparatory <br /> Academy. Section 1121B also prohibits a former public servant for the two-year period <br /> following the termination of his public service from assisting, another:.porson;=Tor-. _ -. <br /> compensation in a transaction,or in an appearance in connection with a transaction,in which <br /> the former public servant participated at any time during his public service and°involving-his <br /> former agency. <br /> • Based on the facts, it does not appear that you will be assisting the Harvest Academy in a <br /> transaction in which you participated as an employee of the Department of Education. <br /> Therefore, there is no violation of the Code if you accept the position of Executive Director <br /> AN EQUAL OPPORTUNITY EMPLOYER <br />
