Alpough <br /> 3622 Hwy 338 <br /> Abbeville, Louisiana 70510 <br /> Re: Ethics Board Docket No.2016-077 <br /> Dear Ms. Alpough: <br /> The Louisiana Board of Ethics, at its March 18, 2016 Board meeting,considered your request for an <br /> advisory opinion regarding whether you may receive compensation for officiating City of Abbeville <br /> Parks and Recreation basketball games.You are employed by the City of Abbeville as a utility collector <br /> within the Utilities Collections Department.Your job duties in this position include accepting payments <br /> from City of Abbeville customers for their light and water bills and settling former customer's deposit <br /> refunds after their services have been discontinued. You stated that you do not perform any work for <br /> the City of Abbeville Parks and Recreation Department and you have no immediate family members <br /> employed by such agency. <br /> You would like to be an official for basketball games for the City of Abbeville Parks and Recreation <br /> Department. You stated that officials are paid cash, as an independent contractor, out of the money <br /> collected at the door the day of their games. Your officiating would be conducted outside of your <br /> working hours for the Utilities Collections Department. <br /> The Board concluded,and instructed me to inform you,that the Code of Governmental Ethics would <br /> not prohibit you from officiating City of Abbeville Parks and Recreation basketball games. La. R.S. <br /> 42:1113A(1)(a) of the Code prohibits a public servant or immediate family member from bidding on <br /> or entering into any contract, subcontract, or other transaction that is under the supervision or <br /> jurisdiction of the agency of such public servant. Your agency is the City of Abbeville Utilities <br /> Collections Department. You would not be prohibited from officiating City of Abbeville Parks and <br /> Recreation basketball games,since neither you or your immediate family members are employed by the <br /> City of Abbeville Parks and Recreations Department. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts presented <br /> may result in a different application of the provisions of the Code of Ethics. The Board issues no <br /> opinion as to past conduct or laws other than Code of Governmental Ethics.
