Fitzpatrick <br /> Fitzpatrick& Burnette <br /> 541 Julia Street, Suite 200 <br /> New Orleans, LA 70130-3690 <br /> Re: Ethics Board Docket No.2016-1028 <br /> Dear Mr. Fitzpatrick: <br /> The Louisiana Board of Ethics,at its January 20, 2017 meeting, considered your request for <br /> an advisory opinion regarding whether James Tassin, Deputy Chief and elected board member <br /> of the Luling Volunteer Fire Department, may accept a paid position with the Luling Volunteer Fire <br /> Department. You stated that Mr. Tassin currently serves as the unpaid volunteer Deputy Chief for the <br /> Luling Volunteer Fire Department and also serves as an unpaid member of its Board of Directors. You <br /> also stated that the Board of Directors for the Luling Volunteer Fire Department would like to hire Mr. <br /> Tassin as its paid General Supervisor to supervise all of its paid employees. You provided further <br /> information that members of the board for the Luling Volunteer Fire Department are elected by its general <br /> membership. <br /> The Board concluded, and instructed me to inform you, that the Code of Governmental Ethics would <br /> prohibit James Tassin from accepting a position as a paid employee for the Luling Volunteer Fire <br /> Department. Section 1113A(1)(a) of the Code prohibits a public servant, his immediate family member, <br /> or a legal entity in which he has a controlling interest from entering into any contract, subcontract, or <br /> other transaction that is under the supervision or jurisdiction of his agency. Section 1121A(2)of the Code <br /> provides that no former member of a board or commission shall, for a period of two years, following the <br /> termination of his public service on such board or commission, contract with, be employed in any <br /> capacity by, or be appointed to any position by that board or commission. Since Mr. Tassin is a member <br /> of the Board of Directors, Section 1113A(1)(a)would prohibit his employment with the Luling Volunteer <br /> Fire Department. Should Mr. Tassin resign his position as a board member, he would be prohibited by <br /> Section 1121A(2) from being employed by the Luling Volunteer Fire Department for a period of two <br /> years after his resignation. <br /> nation.$ <br /> This advisory opinion is based solely on the facts as set forth herein.
