Box 94064 <br /> Baton Rouge, LA 70804 -9064 <br /> RE: Ethics Board Docket No. 2006 - 376 <br /> Dear Ms. Reed: <br /> The Louisiana Board of Ethics, at its June 8, 2006 meeting, considered your request for an advisory <br /> opinion concerning the propriety of your accepting employment with Home Bound Monitoring <br /> Pretrial and Diversion Program for Youth, a non - profit agency, within two years of the termination <br /> of your position with the Louisiana Department of Education ( "LDE ") as the assistant director of the <br /> Recovery School District ( "RSD "). The RSD is administered by the LDE and exists for the purpose <br /> III of taking over schools that have been labeled "academically unacceptable." One of the ways that <br /> such a school can be operated is pursuant to a Type 5 charter agreement between Board of <br /> Elementary and Secondary Education ( "BESE ") and a non - profit corporation. You state that the non- <br /> profit agency will be submitting an application to BESE to operate a charter school. As the assistant <br /> director of the RSD you have no authority to make policy or to make any managerial decisions for <br /> the RSD and that you do not score or evaluate applications submitted to the RSD by non - profit <br /> organizations. <br /> With respect to each specific question, the Board concluded and instructed me to inform you of the <br /> following: <br /> 1. Would I violate La. R.S. 42:1111, 42:1112, 42:1121 or any other provision of the Code of <br /> Governmental Ethics if I take a temporary leave of absence from my LDE/RSD position as the <br /> assistant director of the RSD for the following: <br /> a. To work with a non - profit entity as the Chief Academic Officer. <br /> b. To work with a non - profit entity as the Director of the charter school. <br /> A. Section 1111 C(2)(d) of the Code of Governmental Ethics prohibits a public employee from <br /> receiving anything of economic value from a person who has or is seeking to have a contractual, <br /> • business or other financial relationship with the public servant's agency. Therefore, you would be <br /> prohibited from working for Home Bound Monitoring Pretrial and Diversion Program for Youth <br /> AN EQUAL OPPORTUNITY EMPLOYER <br />
