BOX 90 <br /> Jena, Louisiana 71342 <br /> Re: Docket No. 2025-110 <br /> Advisory Opinion <br /> Dear Superintendent Garrett: <br /> The Louisiana Board of Ethics, at its April 4, 2025 meeting, considered your request for an <br /> advisory opinion regarding whether the Lasalle Parish School Board is prohibited by the Code of <br /> Governmental Ethics (Code) from hiring Josh Linsey as a part time coach at Jena High School <br /> while his wife Rae Lindsey is employed at Jena High. <br /> FACTS <br /> Rae Lindsey is currently employed as a secondary teacher and dance line coach by Jena High <br /> School. Rae Lindsey's spouse Josh Lindsey volunteered at LaSalle High School as CECP coach <br /> for several years. The LaSalle Parish School Board would like to know if they can pay Josh <br /> Lindsey $400 to coach at Jena High School. This would be a one-time payment from the school <br /> Board. Rae Lindsey would not be involved in Josh Lindsey's coaching duties. The Principal of <br /> Jena High would supervise Josh Lindsey. <br /> LAW <br /> La. R.S. 42:1113A(1)(a)of the Code prohibits public servants,their immediate family members, <br /> or legal entities in which they have a controlling interest, from entering into any contract, <br /> subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such <br /> public servant. <br /> La. R.S. 42:1102(2)(a) defines "agency" to mean a department, office, division, agency, <br /> commission, board, committee, or other organizational unit of a governmental entity. <br /> La. R.S. 42:1102(19) defines "public servant" as a public employee or elected official. <br /> La. R.S. 42:1102(18)(a) defines "public employee"to mean any person, whether compensated or <br /> not who is: (i) an administrative officer or official of a governmental entity who is not filling an <br /> elective office; (ii) appointed by any elected official when acting in an official capacity, and the <br /> Page 1 of 2 (BD 2025-110) <br /> AN EQUAL OPPORTUNITY EMPLOYER <br />
