You stated that Lacy Davis is currently a volunteer for the District <br /> and her father, David Austin, Jr. is a member of the District's board. <br /> The Board concluded, and instructed me to infotn you, that the Code of Governmental Ethics <br /> will prohibit Lacy Davis from being employed as a part-time employee of the District. La. R.S. <br /> 42:1119A prohibits an immediate family member of an agency head from being employed by his <br /> agency. La. R.S. 42:1102(3) defines "agency head" as the chief executive or administrative <br /> officer of an agency or any member of a board or commission who exercises supervision over <br /> the agency. As a board member of the District, David Austin, Jr. is considered an agency head of <br /> the District. Therefore, Mr. Austin's daughter, Lacy Davis, is prohibited from being employed <br /> with the District. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Ethics. The <br /> Board issues no opinion as to past conduct or as to laws other than the Code of Governmental <br /> Ethics.
