16. <br /> Based on the foregoing facts, Walter C. Lee violated La. R.S. 42:1115(A)(1) by virtue of <br /> his receipt of a thing of economic value, a discount on the purchase price of a vehicle that was <br /> previously leased to DPSS, as a gift or gratuity from Mansfield Auto World at a time when <br /> Mansfield Auto World had a contractual or other business or financial relationship with DPSS. <br /> 17. <br /> La. R.S. 42:1153 provides with respect to penalties: <br /> B. Upon fording that any public employee or other person has <br /> violated any provision of any law within the jurisdiction of the board . . ., <br /> the board by a majority vote of the membership, may remove, suspend, or <br /> order a reduction in pay, or demotion of the public employee or other <br /> person, or impose a fine of not more than ten thousand dollars, or both. <br /> La. R.S. 42:1155 provides with respect to penalties: <br /> A. If an investigation pursuant to R.S. 42:1141 reveals that any public <br /> servant or other person has violated any law within the jurisdiction of the <br /> board to his economic advantage, the board may order the payment of <br /> penalties. Recovery may include, in addition to an amount equal to such <br /> economic advantage, penalties not to exceed one half of the amount of the <br /> economic advantage. . . <br /> 18. <br /> As evidenced by his signature below, and in an effort to resolve this dispute, Walter C. <br /> Lee: (a) agrees to the Board's finding that violations of La. R.S. 42:1111A, La. R.S. 42:1112A <br /> and La. R.S. 42:1115(A)(1) occurred based on the foregoing facts, (b) acknowledges that upon <br /> his signature being affixed to this consent decree, this document will be available to the public as <br /> a public record, (c) agrees that this order and decree is final, waives his right of appeal or to <br /> otherwiseseek a return of the payment as the penalty, and (d) agrees to pay the penalty assessed <br /> Page 4 of 7 <br />
