Advisory opinion that the daughter of a captain within the Leesville Fire Department would not be prohibited by the Louisiana Code of Governmental Ethics from being employed as a firefighter with the Leesville Fire Department since her father does not appear to be an agency considering the Fire Chief of Leesville Fire Department has the sole authority to hire, fire, and prepare work schedules of the Department. However, the father would be prohibited from participating in any matters involving the Department in which his daughter would have a substantial economic interest.

South Street <br /> Leesville,LA 71446 <br /> Re: Ethics Board Docket No.2016-1014 <br /> Dear Chief Bush: <br /> The Louisiana Board of Ethics,at its November 18,2016 meeting,considered your request for an advisory <br /> opinion as to whether Morgan Dixon may be employed as a firefighter with the Leesville Fire Department. <br /> You stated that you, as Fire Chief of Leesville Fire Department, have the sole authority to hire and fire <br /> employees and prepare their work schedules. You also stated that Morgan Dixon's father, Captain Stacy <br /> Dixon,works at the Leesville Fire Department and supervises Shift 3.Finally,you stated that Morgan Dixon <br /> will not be placed under the supervision of his father and will be scheduled to work in either Shift 1 under <br /> the authority of Captain Eric Baker or in Schedule 2 under the supervision of Captain William Tibbitts. <br /> The Board concluded, and instructed me to inform you that the Code of Governmental Ethics does not <br /> prohibit Morgan Dixon from being employed as a firefighter with the Leesville Fire Department. La. R.S. <br /> 42:1119A prohibits an immediate family member of an agency head from being employed in his agency. <br /> Based on the information submitted,including the facts that the Fire Chief of Leesville Fire Department has <br /> the sole authority to hire and fire employees and prepare their work schedules,it does not appear that Captain <br /> Stacy Dixon is an agency head.Therefore,Morgan Dixon's employment with the Leesville Fire Department <br /> is not prohibited at a time when his father serves as Captain of Shift 3. <br /> However,the Board concluded,and instructed me to inform you that La.R.S.42:1112B(1)prohibits Captain <br /> Stacy Dixon from participating in any matters involving the Leesville Fire Department in which Morgan <br /> Dixon would have a substantial economic interest. La. R.S. 42:1112B(1) prohibits a public servant from <br /> participating in a transaction involving his governmental entity in which a member of his immediate family <br /> has a substantial economic interest. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as presented may <br /> result in a different application of the provisions of the Code of Ethics. The Board issues no opinion as to <br /> past conduct or as to laws other than the Code of Governmental Ethics.
