5. <br /> In 2012, Larry Doiron, Inc.entered into a contract with the City of Morgan City to repave roads. <br /> Between October 16, 2012 and December 20, 2012, Intercoastal sold and delivered cement products for <br /> the city project,for which Larry Doiron, Inc. paid $100,052.51 to Intercoastal. <br /> 6. <br /> Michael Loupe was neither an employee nor a consultant of Intercoastal. Mr. Loupe did not <br /> receive a salary, consultant fee or member distribution during the year 2012 from Intercoastal. <br /> 7. <br /> Mary Loupe was neither an employee nor a consultant of Intercoastal. Mrs. Loupe did not <br /> receive a salary,consultant fee or member distribution during the year 2012 from Intercoastal. <br /> 8. <br /> If called to testify, Mr. Loupe would state that during the summer of 2011, Mr. Loupe contacted <br /> the City Attorney for the City of Morgan City, met with the City Attorney and the Mayor,as well as <br /> contacted the Office of the Attorney General—all for the purpose of ensuring that the provision of <br /> cement products by a company owned by his family would not create any untoward conflicts of interest <br /> or other ethical concerns. <br /> 9. <br /> Intercoastal does not currently provide goods or services to be used on city projects or to or for <br /> Southern Constructors, LLC or Larry Doiron, Inc. on any projects. <br /> 10. <br /> Intercoastal agrees that it will request an advisory opinion from the Board of Ethics in the future, <br /> if it would like to provide goods and services 1)for or to be used in connection with a project/contract <br /> with the City of Morgan City(R.S.42:1113A) and/or 2)to or for a person that has or is seeking to have a <br /> contractual, business or financial relationship with the City of Morgan City(R.S.42:1111C(2)(d)). <br /> Intercoastal will seek the advisory opinion prior to the provision of the goods and services. <br /> 11. <br /> La. R.S.42:1111C(2)(d) provides that no public servant, and no legal entity in which the public <br /> servant exercises control or owns an interest in excess of 25%, shall receive any thing of economic value <br /> for or in consideration of services rendered, or to be rendered,to or for any person during his public <br /> service unless such services are neither performed for nor compensated by any person from who such <br /> public servant would be prohibited by R.S.42:1115A(1)or(B)from receiving a gift. <br />
