__.......... . . <br /> La.R.S.42:1155 provides with respect to penalties: <br /> A. if an investigation pursuant to R.S. 42:1141 reveals that any public servant or <br /> other person has violated any law within the jurisdiction of the board to her <br /> economic advantage,the board may order the payment of penalties. Recovery <br /> may include, in addition to an amount equal to such economic advantage, <br /> penalties not to exceed one half of the amount of the economic advantage... <br /> 9. <br /> As evidenced by her signature below, Helen Tucker knowingly and of her own free will <br /> (a) agrees that the charges are factually supported by facts stated herein, (b) agrees that she <br /> violated La. R.S. 42:1113B, (c) acknowledges that upon her signature being affixed to this <br /> consent decree, this document will be available to the public as a public record, (d) agrees that <br /> this order and decree is final and waives her right of appeal. <br /> ORDER AND DECREE <br /> IT IS ORDERED that Helen Tucker violated La. R.S. 42:1113B by entering into a <br /> contract with the Downsville Charter School to provide substitute teaching services to the charter <br /> school at a time when her daughter, Vicki Antley, served as Board Member of Downsville <br /> Charter School. <br /> IT IS FURTHER ORDERED that based on the totality of the circumstances, no civil <br /> penalty be assessed on Helen Tucker. <br /> 3 <br />
