5. <br /> On November 2, 2015, Mr. Becnel filed a thirty days prior to the election (30-P) <br /> campaign finance report. The report disclosed a $1,500 contribution made by A3M Vacuum <br /> Services on September 1,2015. <br /> 6. <br /> Based on the foregoing facts, Mr. Becnel received $500.00 in excessive contributions <br /> from A3M Vacuum Services in violation of La.R.S. 18:1505.2H. <br /> 7. <br /> La. R.S. 18:1505.2J provides that any person who violates any provision of La. R.S. <br /> 18:1505.2H shall be assessed a penalty of not more than $5,000 or the amount of the violation, <br /> whichever is greater, except that the penalty for a knowing and willful violation shall be not <br /> more than$10,000 or 200% of the violation,whichever is greater. <br /> 8. <br /> As evidenced by his signature below, Kurt Becnel knowingly, intentionally, and of his <br /> own free will (a) agrees that the charges are factually supported by the facts stated herein; (b) <br /> agrees that he violated La. R.S. 18:1505.2H, as described above; (c) waives his right of appeal; <br /> (d) acknowledges that upon his signature being affixed to this consent decree,this document will <br /> be available to the public as a public record; (e) agrees that this order and decree is final, waives <br /> his right of appeal or to otherwise seek a return of the payment as the penalty; and (f) agrees to <br /> pay the penalty assessed herein and otherwise to comply with any other term or condition in the <br /> following order and decree of the Board. <br /> Page 2 of 5 <br />
