IlardN: <br /> The Louisiana Board of Ethics. at its meeting on July 8, 2022, considered your request for an <br /> advisory opinion concerning any potential issues involving the Code of Governmental Ethics <br /> ("Code") and your service as elected officials for the City of Abbeville. given the fact that you are <br /> brothers. <br /> FACTS PROVIDED <br /> You were both elected to positions in the City of Abbeville in the Spring 2022 elections, and were <br /> sworn into office on July 1, 2022. Tony Hardy was elected Councilman, District A. Mike Hardy <br /> was elected chief of police. Tony Hardy served as the Abbeville Chief of Police prior to July 1, <br /> 2018; however, he has not served as a reserve officer for the City. Tony Hardy is interested in <br /> serving as a reserve officer. As chief of police, Mike Hardy would have to issue Tony Hardy's <br /> commission as a reserve officer. <br /> ISSUES <br /> 1. Can Tony Hardy, as councilman, participate in the following matters, or any other <br /> transaction not considered: <br /> a. Establish or amend the budget for the police department? <br /> b. Adjust the salary of the chief of police? <br /> C. Ratify the appointment of police officers? <br /> d. Adjust the salary of police officers? <br /> e. Sign requisitions for the police department? <br /> f. Approve purchases for the police department which are not included in the <br /> department's budget? <br /> 2.
