person: (1) Has or is seeking to obtain contractual or other business or financial relationships with public servant's agency. La. R.S. 42:1102(2)(a) defines "agency" as a department, office, division, agency, commission, board, committee, or other organizational unit of a governmental entity. La. R.S. 42:1102(12) defines "governmental entity" as the state or any political subdivision to which the elected official is elected. La. R.S. 42:1102(18) defines "public employee" as anyone, whether compensated or not, who is: (i) An administrative officer or official of a governmental entity who is not filling an elective office. (ii) Appointed by any elected official when acting in an official capacity, and the appointment is to a post or position wherein the appointee is to serve the governmental entity or an agency thereof, either as a member of an agency, or as an employee thereof. (iii) Engaged in the performance of a governmental function. (iv) Under the supervision or authority of an elected official or another employee of the governmental entity. La. R.S. 42:1102(19) defines"public servant" as a public employee or elected official. ANALYSIS Pursuant to La. R.S. 42:1111(C)(1)(a), you cannot receive compensation or anything of economic value from 21St Century Cop for services that are devoted substantially to the responsibilities, programs, or operations of LPSO and in which you have participated. You have not taught surveillance classes to any member of LPSO or created virtual training content on surveillance as part of your official duties as a Lieutenant. La. R.S. 42:1111(C)(1)(a) permits you to receive compensation for surveillance training services rendered to 21St Century Cop. Pursuant to La. R.S. 42:1111(C)(2)(d),you cannot receive compensation or any thing of economic value for services rendered to 21 St Century Cop, if 21 St Century Cop has or is seeking to obtain contractual or other business or financial relationships with LPSO. Since LPSO has never done any business with 21St Century Cop and there is no plan for 21"Century Cop to do business with LPSO in the future, you are permitted to receive compensation from 21St Century Cop for surveillance training services rendered as a content creator. CONCLUSION The Board concluded, and instructed me to inform you,that based on the facts provided,the Code of Governmental Ethics permits you to obtain secondary employment with 21s' Century Cop Academy, LLC.
