Garrett, III <br /> 635 Main Street <br /> Unit#3 <br /> Baton Rouge, Louisiana 70801 <br /> Re: Docket No. 2023-136 <br /> Advisory Opinion <br /> Dear Mr. Garrett: <br /> The Louisiana Board of Ethics, at its April 5, 2023 meeting, considered your advisory opinion <br /> request, on behalf of West Baton Rouge Parish Government(the"Parish"),as to whether the Code <br /> of Governmental Ethics ("Code")would prohibit an employee from certain outside employment. <br /> FACTS PROVIDED <br /> Ben Bello is an employee of the Parish, serving as a building inspector within the Parish Planning <br /> and Development Department (the "Department"). His duties include conducting inspections to <br /> ensure compliance with the Louisiana State Uniform Construction Code. <br /> Mr. Bello has been offered part-time employment with a private employer, Easley Builders <br /> ("Easley"). Easley performs construction projects in the Parish, as well as other surrounding <br /> parishes. <br /> Mr. Bello would not have any role performing inspections on work done by Easley, and would <br /> have no role on behalf of Easley with respect to applications or inspections. <br /> You would like to know whether Mr. Bello may be employed by Easley. <br /> LAW <br /> La. R.S. 42:1111C(2)(d) provides that no public servant and no legal entity in which the public <br /> servant exercises control or owns an interest in excess of twenty-five percent, shall receive any <br /> thing of economic value for or in consideration of services rendered, or to be rendered, to or for <br /> any person during his public service unless such services are: (d) Neither performed for nor <br /> compensated by any person or from any officer, director, agent, or employee of such person, if <br /> such public servant knows or reasonably should know that such person has or is seeking to obtain <br /> contractual or other business or financial relationships with the public servant's agency; conducts <br /> operations or activities which are regulated by the public employee's agency; or has substantial <br /> Page 1 of 3 (BD 2023-136) <br /> AN EQUAL OPPORTUNITY EMPLOYER <br />
