anything of economic value for or in consideration of services rendered, or to be rendered, to or for any person during his public service unless such services are: (d)Neither performed for nor compensated by any person from whom such public servant would be prohibited by R.S. 42:1115(A)(1) or(B) from receiving a gift. La.R.S.42:1115(A)(1)provides that no public servant shall solicit or accept,directly or indirectly, anything of economic value as a gift or gratuity from any person or from any officer, director, agent, or employee of such person, if such public servant knows or reasonably should know that such person: (1) Has or is seeking to obtain contractual or other business or financial relationships with the public servant's agency. ANALYSIS By entering into a Professional Service Agreement with East Feliciana Parish Police Jury to serve as its Financial Advisor, you would be considered a public servant pursuant to La. R.S. 42:1102(18)and (19). Your agency would be the East Feliciana Parish Police Jury. As a public servant, La. R.S. 42:1111C(2)(d)prohibits you from providing compensated services to Landmark Bank,while the Landmark Bank has a contractual,business,or financial relationship with your agency,the East Feliciana Parish Police Jury. CONCLUSION The Board concluded, and instructed me to inform you that if you were to enter into a Professional Service Agreement with the East Feliciana Parish Police Jury, La. R.S.42:1111(C)(2)(d)prohibits you from providing compensated services to Landmark Bank. This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as presented may result in a different application of the provisions of the Code of Governmental Ethics.
