anything of economic value for or in consideration of services rendered, or to be rendered, to or <br /> for any person during his public service unless such services are: <br /> (d)Neither performed for nor compensated by any person from whom such public servant would <br /> be prohibited by R.S. 42:1115(A)(1) or(B) from receiving a gift. <br /> La.R.S.42:1115(A)(1)provides that no public servant shall solicit or accept,directly or indirectly, <br /> anything of economic value as a gift or gratuity from any person or from any officer, director, <br /> agent, or employee of such person, if such public servant knows or reasonably should know that <br /> such person: <br /> (1) Has or is seeking to obtain contractual or other business or financial relationships with the <br /> public servant's agency. <br /> ANALYSIS <br /> By entering into a Professional Service Agreement with East Feliciana Parish Police Jury to <br /> serve as its Financial Advisor, you would be considered a public servant pursuant to La. R.S. <br /> 42:1102(18)and (19). Your agency would be the East Feliciana Parish Police Jury. <br /> As a public servant, La. R.S. 42:1111C(2)(d)prohibits you from providing compensated services <br /> to Landmark Bank,while the Landmark Bank has a contractual,business,or financial relationship <br /> with your agency,the East Feliciana Parish Police Jury. <br /> CONCLUSION <br /> The Board concluded, and instructed me to inform you that if you were to enter into a Professional <br /> Service Agreement with the East Feliciana Parish Police Jury, La. R.S.42:1111(C)(2)(d)prohibits <br /> you from providing compensated services to Landmark Bank. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Governmental <br /> Ethics.
