Ethics Board Docket No.2021-726 <br /> Page 3 of 6 <br /> 6. <br /> In June of 2022, the United States Attorney's Office for the Western District of Louisiana <br /> charged Ms. Cooper with embezzling, stealing, and obtaining by fraud money that was under the <br /> care, custody, and control of the Cottonport Housing Authority. <br /> 7. <br /> Ms. Cooper was sentenced to imprisonment for 3 months and ordered to pay restitution in <br /> the amount of$30,079.05 payable to the Cottonport Housing Authority. <br /> IV. <br /> PROVISIONS OF LAW: <br /> 8. <br /> La. R.S. 42:1111(A)(1)(a) provides that no public servant shall receive anything of <br /> economic value, other than compensation and benefits from the governmental entity to which he <br /> is duly entitled, for the performance of the duties and responsibilities of his office or position. <br /> 9. <br /> La. R.S. 42:1102 provides the following relevant definitions when analyzing the above <br /> Sections: <br /> (18)(a)defines a"public employee"to mean anyone,whether compensated or not, <br /> who is: (i) an administrative officer or official of a governmental entity who is not <br /> filling an elective office; (ii) Appointed by any elected official when acting in an <br /> official capacity, and the appointment is to a post or position wherein the appointee <br /> is to serve the governmental entity or an agency thereof, either as a member of an <br /> agency, or as an employee thereof; (iii) Engaged in the performance of a <br /> governmental function; or (iv) Under the supervision or authority of an elected <br /> official or another employee of the governmental entity. <br /> (19) defines "public servant"to mean a public employee or elected official. <br />
