You would like to serve as a member of the Crime Prevention and Improvement District <br /> for the Monticello Subdivision. The Crime Prevention and Improvement District is a political <br /> subdivision of the state as defined in the Constitution of Louisiana. The district is established for <br /> the primary object and purpose of promoting and encouraging the beatification, security, and <br /> overall betterment of the district. The district is governed by a seven-member board of <br /> commissioners.The member of the East Baton Rouge Parish Metropolitan Council,whose district <br /> encompasses all or the greater portion area of the district, shall appoint one member.All members <br /> serve without compensation. <br /> LAw <br /> La. R.S. 42:1113A(1)(a) No public servant, excluding any legislator and any appointed member <br /> of any board or commission and any member of a governing authority of a parish with a population <br /> of ten thousand or less, or member of such a public servant's immediate family, or legal entity in <br /> which he has a controlling interest shall bid on or enter into any contract, subcontract, or other <br /> transaction that is under the supervision or jurisdiction of the agency of such public servant. <br /> ANALYSIS AND CONCLUSION <br /> The Board concluded and instructed me to inform you that La. R.S. 42:1113A prohibits you from <br /> being appointed by the East Baton Rouge Council to the Crime Prevention and Improvement <br /> District.Additionally, this may present an issue addressed by the Louisiana Dual Office-Holding <br /> Laws, which are under the jurisdiction of the Attorney General. The Board suggests you contact <br /> that office regarding the application of those laws.
