Ethics Board Docket No. 2023-1093 <br /> Page 2 of 9 <br /> II. <br /> JURISDICTION: <br /> 1. <br /> The BOE is an agency of the State of Louisiana domiciled in East Baton Rouge Parish, <br /> Louisiana. <br /> 2. <br /> The BOE is authorized to offer a Consent Opinion to Mr. McKinney by virtue of Section <br /> 1141C(3)(� of the Ethics Code. <br /> III. <br /> FINDINGS OF FACT: <br /> 1. <br /> Mr. McKinney began his employment with MPD in November 2021, as a part-time patrol <br /> officer. Mr. McKinney was promoted to the position of Assistant Chief in January 2024, and he <br /> became a full-time employee of MPD in June 2024. As an employee of MPD, Mr. McKinney is a <br /> "public servant" as defined by La. R.S. 42:1102(19). MPD is the "agency" of Mr. McKinney as <br /> defined by La. R.S. 42:1102(2)(a)(vi). <br /> 2. <br /> On August 14,2023,the Mangham Board of Aldermen adopted Ordinance No.2023 which <br /> provided for the use of a photographic vehicle speed enforcement system("PSE")to enforce speed <br /> limits. Ordinance No. 2023 specifically stated that MPD is responsible for the enforcement and <br /> administration of such ordinance,but allowed that MPD could utilize third-party contractors. <br />
