4. <br /> Gwendolyn Clcnient has not completed a one-hour training on the Code of Govenunental <br /> Ethics for calendar year 2020. <br /> 1v. <br /> PROVISIONS OF LAW* <br /> (a) La. R.S. 42:1102(12) "Govemmental Entity,� means the state or any political <br /> subdivision which employs the public employee or employed the former public employee or to <br /> which the elected official is elected. as the case may be. <br /> (b) La. R.S. 4 :1102(1,8) ."public Employee" to mean anyone, whether compensated or <br /> not, who is'(i) an admim'strative officer or official of a govermnental entity who is not filling an <br /> elective office. ii) appointed by any elected official when acting in an official capacity, and the <br /> appointment is to a post or positron wherein the appointee is to serve the governmental entity or <br /> an agency thereof, either as a member of an agency, or as an employee thereof. (iii) engaged in the <br /> pexfonnance of a. governmental f mction. (iv) under the supervision or authority of an elected <br /> official or another employee of the govenunental entity. <br /> (c) La.. R.S.42:1102(19)defines "Public servant"to mean a.public employee or an elected <br /> official. <br /> (d) La. 1 R.S. 42:117OA( )(a)(i) Commencing on January 1,2012,each public servant who <br /> was not required to complete education and training pursuant to. paragraph (1) or ) of this <br /> Subsection shall receive a minimum of one hour of education and training on the Code of <br /> Governmental Ethics during each year of his piiblic employment or term of office, as the case may <br /> bei <br /> (e) La.. R.S.4 .1170E(2) If the hoard discovers that a public servant or lobbyist has failed <br /> to complete the training required by this Section., the hoard shall snail by certified marl a notice of <br /> noncompliance informing the person that the training required by this Section shall be completed <br /> v,ithin forty-five business days from the mailing of the notice of noncompliance. The notice of <br /> noncompliance shall include the deadline for completion of the training required by this Section. <br /> If the person completes the training prior to the deadline contained in the notice of noncompliance, <br /> no penalties shall he assessed against the person. <br /> (f) La.
