Ethics Board Docket No. 2022434 <br /> Page 7 of 13 <br /> of Ethics to his economic advantage, and after an adjudicatory hearing on the <br /> matter, the Ethics Adjudicatory Board may order the payment of penalties. <br /> Recovery may include, in addition to an amount equal to such economic <br /> advantage, penalties not to exceed one half of the amount of the economic <br /> advantage. Any appeal of such final decision by the Ethics Adjudicatory Board <br /> shall be to the Court of Appeal, First Circuit,pursuant to R.S. 42:1142. <br /> V. <br /> OPINION: <br /> It is the opinion of the BOE that each of Scott Hearne, Frederick Williams and Michael <br /> Roberts, in their capacities as members of the LSBHI violated Section 1111 C(2)(d) of the Ethics <br /> Code by virtue of receiving compensation for providing continuing education services to persons <br /> who conduct operations or activities which are regulated by the LSBHI. Section 1111C(2)(d) of <br /> the Ethics Code prohibits members of the LSBHI from receiving compensation for providing <br /> continuing education classes to persons who are regulated by the LSBHI. Members of the <br /> LSBHI we public employees within the agency of the LSBHI, and persons obtaining continuing <br /> education credit are regulated by the LSBHI. <br /> It is the opinion of the BOE that Michael Roberts, in his capacity as a member of the <br /> LSBHI, violated Section 1113B of the Ethics Code virtue of his application to the LSBHI for <br /> approval to be a continuing education provider. Section It 13B of the Ethics Code prohibits <br /> members of the LSBHI from applying to be continuing education providers, as the submission of <br /> such an application represents a transaction with LSBHI. <br /> Michael Roberts, while serving as a member of the LSBHI, submitted an application to <br /> be continuing education providers and each of Scott Hearne, Frederick Williams and Michael <br />
