If an investigation conducted pursuaxxt to this Part reveals that any public <br /> servant or other person has violated any Iaw within the jurisdiction of the Board of <br /> Ethics to his economic advantage,and after an adjudicatory hearing on the zrxatter, <br /> the Ethics Adjudicatory Board may order the paynnent of penalties.Recovery may <br /> inctude, in addition to an amount equal to such economic advaxataae,penalties not <br /> to exceed ane half of the amount o�th:e economic advanta,ge. Any appeal of such <br /> final decision by the Ethics Adjudicatory Board shall be to tlae Court of Appeal, <br /> First Circuit,pursuant to R.S.42:1 i 42. <br /> V. OPINION <br /> It is tlae opinion of the BOE that Jeffrey M. Landry's, in his capacity as Attorney General <br /> far the State of Louisiana, failure to file the appropriate paperwork set forth in Section 1115.2 of <br /> the Ethics Code resulted in a violation of Section 1111A of the Ethics Code. Had Mr. Landry <br /> timely coz�xplied with the conditions set forth in Section 1115.2 of the Ethics Code,there would be <br /> no violation. <br /> if this matter proceeded to a public hearing befare the Ethics Adjudicatory Baard,and the <br /> Ethics Adjudicatory Board had found a violation of the Ethics Code,the Ethics Adjudicatory Board <br /> could impose a fine of up to $10,000 for each violation of the Ethics Code, pursuant to Section <br /> 11538 of the Ethics Code. The Ethics Adjudicatory Board canld also impose penalties equal to <br /> one-ar�d-a-half tinnes the amount of�conomic advantage gained,pursuant to Section 1155A of the <br /> Ethics Code. In this particular situation, it is the conclusion of the Board that the interest of the <br /> gublic would be served by, and the parties have a�eed to resolvin�this matter amicably thraugh <br /> the publica.tion ofthis Consent Opinion with the imposition of a$900 civil penalty against Jeffrey <br /> M.
