La. R.S. 42:1102(23) defines "transaction involving the governmental entity" to mean any <br /> proceeding, application, submission, request for a ruling or other determination, contract, claim, <br /> case, or other such particular matter which the public servant or former public servant of the <br /> governmental entity in question knows or should know: (a) Is, or will be, the subject of action by <br /> the governmental entity. (b)Is one to which the governmental entity is or will be a party. (c)Is one <br /> in which the governmental entity has a direct interest. <br /> ANALYSIS <br /> Jimmy Verret is a public employee pursuant to La. R.S. 42:1102(18)(a) and a public servant <br /> pursuant to La. R.S. 42:1102(19). As a member of the District's Board, he is an agency head of <br /> the District as provided in La. R.S. 42:1102(3). Jimmy Verret's agency is the District pursuant to <br /> La. R.S. 42:1102(2)(a)(vi). Joby Verret is the immediate family of Jimmy Verret pursuant to La. <br /> R.S. 42:1102(13). <br /> 1. Whether Joby Verret may be employed with the District if his brother, Jimmy Verret, <br /> resigns from the District's Board? <br /> Generally, La. R.S. 42:1119A prohibits Joby Verret from being employed with the District while <br /> Jimmy Verret is a member of the District's Board. However, once Jimmy Verret resigns, Joby <br /> Verret is not prohibited from being employed with the District. <br /> 2. Whether Jimmy Verret may be reappointed to the District's Board while his brother, <br /> Joby Verret, is employed with the District? <br /> Generally, La. R.S. 42:1113A prohibits an immediate family member from entering into a <br /> transaction under the supervision or jurisdiction of the immediate family member's agency. La. <br /> R.S. 42:1121A(2) prohibits a former member of a board or commission from being appointed to <br /> any position. Since the Terrebonne Parish Council is the appointing authority for members of the <br /> District's Board,Jimmy Verret is not prohibited from being appointed to the District's Board while <br /> his brother is employed with the District. <br /> However, La. R.S. 42:1119A will prohibit Joby Verret's continued employment with the District <br /> unless he has been employed with the District for at least one year prior to Jimmy Verret's <br /> appointment. <br /> Additionally, while Jimmy Verret is a member of the Board, La. R.S. 42:1112B(1)would prohibit <br /> him from participating in a transaction involving the District in which his brother has a substantial <br /> economic interest. Therefore, Jimmy Verret shall recuse himself from voting and shall be <br /> prohibited from participating in any discussion and debate concerning the matter as provided in <br /> La.
