Upan a determination that any public employee or other person has violated any <br /> provision of any law within the jurisdiction of the Board of Ethics except violations <br /> of the Campaign Finance Disclosure Act which shall be governed by Chapter 11 of <br /> Title 18 of the Louisiana Revised Statutes of 1950, the Ethics Adjudicatory Board <br /> may remove, suspend, or order a reduction in pav, or demotion of the public <br /> employee or other person, or impose a fine of not more than ten thousand dollars, <br /> or both. <br /> V. <br /> OPINION: <br /> � <br /> As an appainted member of the Board of Commissioners for the Concordia Parish Hospital <br /> Service District Number One,James King is a public employee as defined by La.R.S.42:1102(18) <br /> and a public servant as defined by La. R.S. 42:1102(19). The Concordia Parish Hospital Service <br /> District Nurnber One is a political subdivision as defined by La. R.S. 42:1102(17) and a <br /> governmental entity as defined by La. R.S.42:1102(12}. <br /> As a public servant,James King is prohibited by La. R.S. 42:1112B(5) from participating <br /> in transactions invoiv'rng the Concardia Parish Hospital Service District Number Qne in which any <br /> person who is a party to an existing cantract with him and, by reason thereof, is in a position to <br /> directly affect his economic interests has a substantial economic interest. <br /> It is the opinion of the BOE that James King, in his capacity as a member of the Board of <br /> Commissioners far the Concordia Parish Hospital Service District Number One,violated La.R.S. <br /> 42:1112(B)(5) when he participated in three votes ta approve contractual service agreements <br /> between the Concordia Parish Hospital Service District Number One and Dr. Dulam, which Dr. <br /> Dulam had a substantial economic interest, at a time when Dr. Dulam was a party to an existing <br /> lease contract with James King for use of Dr.Dulam's property to graze cattle and exercise hunting <br /> rights and,by reason thereof, was in a position to directly affect James King's economic interests. <br />
