Ethics Board Docket No. 2024-113 <br /> Page 9 of 12 <br /> Tommy Durrett knew or reasonably should have known that Ergon Asphalt&Emulsions, Inc.had <br /> or was seeking to obtain a contractual, other business, or financial relationship with the Union <br /> Parish Police Jury. <br /> Therefore, when Ergon Asphalt & Emulsions, Inc., through its employee Mark Hartman, <br /> gave Tommy Durrett complimentary hotel accommodations for three nights in Nashville, <br /> Tennessee,which was a thing of economic value that he was prohibited from receiving by La.R.S. <br /> 42:1115A(1), Ergon Asphalt&Emulsions, Inc. violated La. R.S. 42:1117. <br /> If this matter proceeded to a public hearing before the Ethics Adjudicatory Board, and the <br /> Ethics Adjudicatory Board found a violation of the Ethics Code, the Ethics Adjudicatory Board <br /> could impose a fine of up to $10,000 for violating the Ethics Code, pursuant to La. R.S. 42:1153 <br /> and La. R.S. 42:1154. <br /> In this particular situation, the parties have agreed to resolve this matter amicably. <br /> Therefore, it is the conclusion of the BOE that the interests of the public and judicial efficiency <br /> would be served through the publication of this Consent Opinion with the imposition of a <br /> $5,000.00 civil penalty against Ergon Asphalt & Emulsions, Inc. In exchange, the BOE will <br /> dismiss all pending charges against Ergon Asphalt & Emulsions, Inc. and its employee, Mark <br /> Hartman. <br />
