At all times <br /> pertinent herein, Allegiance Ag and Turf, LLC had a business and financial relationship with the <br /> City of Bastrop. <br /> La. R.S. 42:1111C(2)(d) prohibited Mr. Bradford and Bastrop-Morehouse Publishers Inc. <br /> from receiving any thing of economic value, including $15,130.00, for weekly newspaper <br /> advertising services rendered, or to be rendered, to or for Allegiance Ag and Turf, LLC, at a time <br /> when Allegiance Ag and Turf, LLC had a business and financial relationship with the City of <br /> Bastrop. <br /> Therefore,when Allegiance Ag and Turf, LLC paid Mr. Bradford and Bastrop-Morehouse <br /> Publishers Inc. a thing of economic value in the form of$15,130.00 for weekly advertising space <br /> in the Bastrop Morehouse News newspaper, which Mr. Bradford and Bastrop-Morehouse <br /> Publishers Inc. were prohibited from receiving by La. R.S. 42:1111C(2)(d), Allegiance Ag and <br /> Turf, LLC violated La. R.S. 42:1117. <br /> If this matter proceeded to a public hearing before the Ethics Adjudicatory Board and the <br /> Ethics Adjudicatory Board found a violation of the Ethics Code, the Ethics Adjudicatory Board <br /> could impose a fine of up to $10,000 for such violation,pursuant to La. R.S. 42:1153 and La. R.S. <br /> 42:1154. <br /> In this particular situation, the parties have agreed to resolve the matter amicably. <br /> Therefore, it is the conclusion of the BOE that the interests of the public and judicial efficiency <br /> would be served through the publication of this Consent Opinion with the imposition of a <br /> $1,000.00 civil penalty against Allegiance Ag and Turf, LLC. <br />
