• ETHICS BOARD <br /> OPINION NO. 92 -088 <br /> PAGE 9 <br /> As to legislators, however, the definition of thing of <br /> economic value is subject to an exception for "reasonable <br /> transportation when organized primarily for educational or <br /> informational purposes." Given the factors previously outlined by <br /> the Board in determining "reasonableness" and, on the basis of the <br /> information provided to the Board by Senator Nunez, the Board has <br /> concluded that the transportation to Hawaii did not constitute the <br /> prohibited receipt of a thing of economic value. <br /> However, the receipt of "lodging" is prohibited by the Code <br /> and the receipt thereof by Senator Nunez was a violation of the <br /> Code. Senator Nunez has reimbursed Mr. Hemmeter the cost <br /> associated with the lodging portion of the Hawaii trip. The Board <br /> is of the opinion that no further investigative action by the <br /> Board, under the existing circumstances, is necessary. <br /> The Governor is likewise prohibited from receiving any <br /> thing of economic value for the performance of the duties and <br /> responsibilities of his position as Governor or from a prohibited <br /> source. <br /> On the basis of the information received by the Board from <br /> the Governor, it does not appear that the transportation and <br /> lodging provided to the Governor to Snowmass, Colorado was given <br /> for the performance of the duties and responsibilities by the <br /> Governor of his office or position or was from a prohibited <br /> • source. In any event, the Governor has chosen to repay to Mr. <br /> Robinowitz an amount sufficient to cover the cost of the airline <br /> ,A, <br />
