Box 1130 <br /> Graud Isle, Louisiana 70358 <br /> Re: Louisiana Board of Ethics Docket No. 2025-478 <br /> Advisory Opinion <br /> Dear Ms. Stelly: <br /> The Louisiana Board of Ethics, at its November 7, 2025 meeting, considered your request for the <br /> approval of a purchasing plan pursuant to La. R.S. 42:1123(22) of the Code of Governmental <br /> Ethics ("Code") regarding your mother's store, Sui•eway Supermarket. <br /> FACTS PROVIDED <br /> You are an elected member of the Town of Grand Isle Council. Your mother, Shel(y Maples, <br /> owns Sureway Supermarket. You state that the Town of Grand Isle is a 7-mile-long barrier island <br /> and is about one hour fi•om Lafourche Parish. You state the closest grocery store other than <br /> Sureway Supermarket, is Rouses Supermarket 45-minutes away. Other stores are about 50- <br /> minutes away. You ask that the Town of grand Isle be allowed to purchase items from Sureway <br /> Supermarket. The Town of Grand Isle has a population of 1,005. <br /> LAW <br /> La. R.S. 42:1113A(1)(a) provides that no public servant, excluding any legislator and any <br /> appointed member of any board or commission and any member of a governing authority of a <br /> parish with a population of ten thousand or less, or member of such a public servant's immediate <br /> family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, <br /> subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such <br /> public servant. <br /> La. R.S. 42:1123(22) provides an exception to the Code, which allows a mayor or member of a <br /> governing authority of a municipality with a population of 5,000 of less, or an immediate family <br /> member of such a mayor or governing authority member, or a legal entity in which such a mayor, <br /> governing authority member, or immediate family member has a controlling interest, to enter into <br /> a transaction that is under the supervision or jurisdiction of the municipality.
