Ethics Board Docket No. 2021-081
from whom such public servant would be prohibited by R.S. 42:1115(A)(1) or(B)
from receiving a gift.
La. R.S.42:1115:
A. No public servant shall solicit or accept, directly or indirectly, any thing of
economic value as a gift or gratuity from any person or from any officer, director,
agent, or employee of such person, if such public servant knows or reasonably
should know that such person:
(1) Has or is seeking to obtain contractual or other business or financial
relationships with the public servant's agency;
V.
OPINION:
It is the opinion of the BOE that S&W Payroll Services LLC violated La. R.S. 42:1117 by
virtue of its payment of$3,846.90 to Jennifer Davis and/or Jenn Davis LLC when S&W Payroll
Services LLC had a contractual, business, or other financial relationship with Jennifer Davis's
agency, St. James Parish.
If this matter proceeded to a public hearing before the Ethics Adjudicatory Board("EAB"),
and the EAB found a violation of the Ethics Code, the EAB could impose a fine of up to $10,000
for each violation pursuant to La. R.S. 42:1153.
In this particular matter, the parties have agreed to resolve this matter amicably. Therefore,
it is the conclusion of the BOE that the interests of the public and judicial efficiency would be
served through the publication of this Consent Opinion without the imposition of a civil penalty.
