R.S.42:1115: <br /> A. No public servant shall solicit or accept, directly or indirectly, any thing of <br /> economic value as a gift or gratuity from any person or from any officer, director, <br /> agent, or employee of such person, if such public servant knows or reasonably <br /> should know that such person: <br /> (1) Has or is seeking to obtain contractual or other business or financial <br /> relationships with the public servant's agency; <br /> V. <br /> OPINION: <br /> It is the opinion of the BOE that S&W Payroll Services LLC violated La. R.S. 42:1117 by <br /> virtue of its payment of$3,846.90 to Jennifer Davis and/or Jenn Davis LLC when S&W Payroll <br /> Services LLC had a contractual, business, or other financial relationship with Jennifer Davis's <br /> agency, St. James Parish. <br /> If this matter proceeded to a public hearing before the Ethics Adjudicatory Board("EAB"), <br /> and the EAB found a violation of the Ethics Code, the EAB could impose a fine of up to $10,000 <br /> for each violation pursuant to La. R.S. 42:1153. <br /> In this particular matter,the parties have agreed to resolve this matter amicably. Therefore, <br /> it is the conclusion of the BOE that the interests of the public and judicial efficiency would be <br /> served through the publication of this Consent Opinion without the imposition of a civil penalty. <br />
