Ethics Board Docket No. 2021-767 <br /> Page 4 of 8 <br /> La.R.S.42:1155A provides that if an investigation conducted pursuant to this Part reveals <br /> that any public servant or other person has violated any law within the jurisdiction of the <br /> Board of Ethics to his economic advantage, and after an adjudicatory hearing on the matter, <br /> the Ethics Adjudicatory Board may order the payment of penalties. Recovery may include, <br /> in addition to an amount equal to such economic advantage, penalties not to exceed one <br /> half of the amount of the economic advantage. <br /> La. R.S. 42:1102. Definitions <br /> Unless the context clearly indicates otherwise,the following words and terms,when used <br /> in this Chapter, shall have the following meanings: <br /> (2)(a)(i) "Agency" to mean a department, office, division, agency, commission, <br /> board, committee, or other organizational unit of a governmental entity. (vi) For <br /> public servants of political subdivisions, it shall mean the agency in which the <br /> public servant serves, except that for members of any governing authority and for <br /> the elected or appointed chief executive of a governmental entity, it shall mean the <br /> governmental entity. Public servants of political subdivisions shall include, but <br /> shall not be limited to, elected officials and public employees of municipalities, <br /> parishes, and other political subdivisions; sheriffs and their employees; district <br /> attorneys and their employees; coroners and their employees; and clerks of court <br /> and their employees. <br /> (18) "Public Employ"to means anyone, whether compensated or not,who is (I) <br /> an administrative officer or official of a governmental entity who is not filling an <br /> elective office. (ii) appointed by any elected official when acting in an official <br /> capacity, and the appointment is to a post or position wherein the appointee is to <br /> serve the governmental entity or an agency thereof, either as a member of an <br /> agency, or as an employee thereof. (iii) engaged in the performance of a <br /> governmental function. (iv)under the supervision or authority of an elected official <br /> or another employee of the governmental entity. <br /> (19) "Public Servant" means a public employee or an elected official. <br /> V. <br /> OPINION: <br /> It is the opinion of the BOE that Patricia Reeves, in her capacity as an employee of Caddo <br /> Magnet High School within the Caddo Parish School System, violated La. R.S. 42:1111C(1)(a), <br /> which prohibited Ms. Reeves from receiving any thing of economic value for any service, the <br />
