-3- <br /> Section 1111 A of the Code provides as follows: <br /> • "1111. Payments from nonpublic sources <br /> A. Payments for services to the <br /> governmental entity. No public servant shall <br /> receive any thing of economic value, other than <br /> compensation and benefits from the governmental <br /> entity to which he is duly entitled, for the <br /> performance of the duties and responsibilities of his <br /> office or position." <br /> This section of the Code contains a broad and general <br /> prohibition against public servants receiving "any thing of economic <br /> value" that is given to them from a "nonpublic source" for the <br /> performance of the duties and the responsibilities of their office or <br /> position." <br /> "Thing of economic value" has been defined in the Code at <br /> Section 1102 (22) as follows: <br /> "1102. Definitions <br /> • * * * * * <br /> (22) 'Thing of economic value' means money or <br /> any other thing having economic value, except <br /> promotional items having no substantial resale value <br /> and food, drink, or refreshments consumed by a <br /> public servant, including reasonable transportation <br /> and entertainment incident thereto, while the <br /> personal guest of some person, and includes but is <br /> not limited to: <br /> (a) Any loan, except a bona fide loan <br /> made by a duly licensed lending . <br /> institution at the normal rate of interest, <br /> any property interest, interest in a <br /> contract, merchandise, service, and any <br /> employment or other arrangement <br /> involving a right to compensation. <br /> (b) Any option to obtain a thing of <br /> economic value, irrespective of the <br /> conditions to the exercise of such option. <br /> (c) Any promise or undertaking for the <br /> • present or future delivery or procurement <br /> of a thing of economic value." <br /> ( 2r <br />
