-4- <br /> Employees of the athletic departments and members of the <br /> • coaching staffs at state colleges and universities are "public servants" <br /> as that term has been defined at Section 1102 (19) of the Code. <br /> Accordingly, it is the opinion of the Commission that the <br /> receipt by athletic personnel and coaches at state colleges and <br /> universities of any thing "of economic value" in the form of money, <br /> personalized articles, automobiles and the use of automobiles, travel, <br /> entertainment, and vacations from "nonpublic sources" under <br /> circumstances such that it is manifest that the "thing of economic value" <br /> is given to the public servant in recognition of, as a reward for, or to <br /> encourage the future performance of, the duties and responsibilities <br /> enjoyed by the coach or athletic department employee in connection with <br /> their public service, is an activity prohibited by Section 1111 A of the <br /> • Code. <br /> Caution should therefore be exercised not only by the <br /> members of the athletic department and coaching staff of colleges and <br /> universities but by other responsible officials at these institutions of <br /> higher education to insure that the provisions of Section 1.111 A of the <br /> Code are not violated by the proscribed receipt from nonpublic sources <br /> of "things of economic value" as more particularly developed above. <br /> BY ORDER OF THE COMMISSION <br /> s/ Robert C.
