(b) The interest that an elected official who is elected to a house,body,or authority has <br /> in a position or office of such house,body,or authority which is required to be filled <br /> by a member of such house,body,or authority by law,legislative rule,or home rule <br /> charter. <br /> (c) The interest that a person has as a member of the general public. <br /> 25. <br /> La. R.S. 42:1153B provides with respect to penalties: <br /> Upon a determination that any public employee or other person has violated any provision <br /> of any law within the jurisdiction of the Board of Ethics..., the Ethics Adjudicatory Board <br /> may remove, suspend, or order a reduction in pay, or demotion of the public employee or <br /> other person,or impose a fine of not more than ten thousand dollars,or both. <br /> 26. <br /> La. R.S. 42:1155A provides with respect to penalties: <br /> If an investigation conducted pursuant to this Part reveals that any public servant or other <br /> person has violated any law within the jurisdiction of the Board of Ethics to his economic <br /> advantage, and after an adjudicatory hearing on the matter, the Ethics Adjudicatory Board <br /> may order the payment of penalties. Recovery may include,in addition to an amount equal <br /> to such economic advantage,penalties not to exceed one half of the amount of the economic <br /> advantage... <br /> 27. <br /> As evidenced by her signature below,Sara Brumfield knowingly and of her own free will(a) <br /> does not contest that the charges are factually supported by stated facts herein; (b)does not contest <br /> that she violated La.R.S.42:11128(1)as described above;(c)acknowledges that upon her signature <br /> being affixed to this consent decree,this document will be available to the public as a public record; <br /> (d)agrees that this order and decree is final,waives her right of appeal or to otherwise seek a return <br /> of the payment as the penalty; and (e) agrees to pay the penalty assessed herein and otherwise to <br /> comply with any other term or condition in the following order and decree. <br /> Page 6 of 9 <br />
