Mayor Foulcard hired Joseph Daniels in the <br /> Sewer Collections Division of the Utility Department at a time when Bernard Daniels was <br /> the Director of the Utility Department and at a time when Mayor Foulcard knew Joseph <br /> Daniels was an immediate family member of Bernard Daniels. Irrespective of Joseph <br /> Daniels having another supervisor over him in the Sewer Collections Division, Bernard <br /> Daniels was the agency head over the Utility Department, which included the Sewer <br /> Collections Division. Therefore, Mayor Foulcard violated Section 1119D of the Ethics <br /> Code by his hiring of Joseph Daniels when he knew of the familia relationship between <br /> Bernard and Joseph Daniels. <br /> If this matter proceeded to a public hearing before the Ethics Adjudicatory Board, <br /> and the Ethics Adjudicatory Board found a violation of the Code of Governmental Ethics, <br /> the Ethics Adjudicatory Board could impose a fine of up to $10,000 for each violation of <br /> the Code. In this particular situation, it is the conclusion of the Board that the interest of <br /> the public would be served by, and the parties have agreed to resolve this matter amicably <br /> through the publication of this Consent Opinion with the imposition of a civil penalty in <br /> the amount of $250 against Bernard Daniels, $250 against Joseph Daniels, and $1,500 <br /> against Eugene Foulcard. <br /> Page 9 of 15 <br /> Ethics Board Docket No. 2020-883 <br />
