Ethics Board Docket No. 2020-876 <br /> Page 6 of 9 <br /> Code by virtue of receiving a thing of economic value for services rendered to State Line while <br /> State Line was seeking and had a business relationship with the District. <br /> Mr. Childress was an employee of State Line and received regular payroll compensation <br /> from State Line for services as an employee during the time in which State Line and the District <br /> were negotiating and consummating a sale of property from State Line to the District. <br /> It is the opinion of the BOE that Justin Childress violated Section 111213(3) of the Ethics <br /> Code by virtue of his participation in the approval and execution of a transaction between his <br /> employer and his agency. <br /> Mr. Childress was an employee of State Line when he voted to approve the transaction <br /> between State Line and the District and when he signed as a witness on the document finalizing <br /> the sale between State Line and the District. <br /> If this matter proceeded to a public hearing before the Ethics Adjudicatory Board, and the <br /> Ethics Adjudicatory Board found a violation of the Code of Governmental Ethics, the Ethics <br /> Adjudicatory Board could impose a fine of up to $10,000 for each violation of the Code. In this <br /> particular situation, it is the conclusion of the BOE that the interest of the public would be served <br /> by, and the parties have agreed to resolving this matter amicably through the publication of this <br /> Consent Opinion with the imposition of a$1,000 civil penalty against Mr. Childress. <br />
