Ethics Board Docket No. 2020-876 <br /> Page 5 of 8 <br /> No public servant or other person shall give, pay, loan, transfer, or deliver or offer <br /> to give, pay, loan, transfer or deliver, directly or indirectly, to any public servant or <br /> other person any thing of economic value which such public servant or other person <br /> would be prohibited from receiving by any provision of this Part. <br /> V. <br /> OPINION: <br /> It is the opinion of the BOE that State Line violated Section 1117 of the Ethics Code by <br /> virtue of providing a thing of economic value to Justin Childress, a board member of the District, <br /> for services rendered to State Line while State Line was seeking and had a business relationship <br /> with the District. <br /> Mr. Childress was an employee of State Line and received regular payroll compensation <br /> from State Line for services as an employee during the time in which State Line and the District <br /> were negotiating and consummating a sale of property from State Line to the District. <br /> If this matter proceeded to a public hearing before the Ethics Adjudicatory Board, and the <br /> Ethics Adjudicatory Board found a violation of the Code of Governmental Ethics, the Ethics <br /> Adjudicatory Board could impose a fine of up to $10,000 for each violation of the Code. In this <br /> particular situation, it is the conclusion of the BOE that the interest of the public would be served <br /> by, and the parties have agreed to resolving this matter amicably through the publication of this <br /> Consent Opinion with the imposition of a$500 civil penalty against State Line. <br />
