Ethics Board Docket No. 2021-139 <br /> Page 2 of 11 <br /> II. <br /> JURISDICTION: <br /> 1. <br /> The BOE is an agency of the State of Louisiana domiciled in East Baton Rouge Parish, <br /> Louisiana. <br /> 2. <br /> The BOE is authorized to offer a Consent Opinion to Rowdy Gaudet by virtue of Section <br /> 1141C(3)(f) of the Ethics Code. <br /> III. <br /> FINDINGS OF FACT: <br /> 3. <br /> The City-Parish is both a municipality (home rule charter) and a parish government <br /> (political subdivision of the State of Louisiana). At an election on August 12, 1947, the voters of <br /> both East Baton Rouge Parish and the City of Baton Rouge adopted the current Plan of <br /> Government (as amended) which consolidated the administration of most local government <br /> services for the City of Baton Rouge and East Baton Rouge Parish. According to the East Baton <br /> Rouge Parish Plan of Government, the Metropolitan Council (the "Metro Council")retains all the <br /> powers and duties of East Baton Rouge Parish, including the exclusive authority to bind and/or <br /> obligate the City-Parish and/or the expenditure of City-Parish funds. <br /> The City-Parish is a "governmental entity" as defined by Section 1102(12) of the Ethics <br /> Code. The Metro Council is a"governing authority" as defined by Section 1102(11) of the Ethics <br /> Code. "Agency," as defined by Section 1102(2)(a)(vi) of the Ethics Code, for a member of the <br /> Metro Council, is the City-Parish. <br />
