Any candidate, the treasurer or chairman of any political committee, or any <br /> other person required to file reports under this Chapter who knowingly and willfully <br /> fails to disclose, or knowingly and willfully fails to accurately disclose, any <br /> information required by this Chapter to be disclosed in the reports required herein, <br /> may be assessed a civil penalty for each day until such information is disclosed by <br /> amendment to the appropriate report of such candidate, political committee, or <br /> other person. "Knowingly and willfully", for purposes of this Subsection, means <br /> conduct which could have been avoided through the exercise of due diligence. <br /> V. <br /> OPINION: <br /> It is the opinion of the BOE, in its capacity as the Supervisory Committee on Campaign <br /> Finance Disclosure, that Karen Carter Peterson, in her capacity as a candidate for State Senator, <br /> 5th Senatorial District, in the October 12, 2019 election and in her capacity as chairperson of the <br /> Committee, violated Section 1505.2I of the CFDA by using campaign contributions for personal <br /> use unrelated to her campaign. Section 1505.21 of the CFDA prohibits Karen Carter Peterson from <br /> using campaign contributions for reasons unrelated to her campaign or the holding of public office. <br /> It is the opinion of the BOE, in its capacity as the Supervisory Committee on Campaign <br /> Finance Disclosure, that Karen Carter Peterson, in her capacity as a candidate for State Senator, <br /> 5th Senatorial District, in the October 12, 2019 election and in her capacity as chairperson of the <br /> Committee, violated Section 1505.1 C of the CFDA by filing inaccurate campaign finance <br /> disclosure reports. Section 1505.1C of the CFDA requires Karen Carter Peterson to accurately <br /> disclose all contributions to and expenditures by campaign accounts. <br /> Karen Carter Peterson,over the course of multiple years,diverted funds from her campaign <br /> account and the Committee's account for personal use. Such personal use was not accurately <br /> disclosed in her or the Committee's campaign finance disclosure reports. <br /> If this matter proceeded to a civil lawsuit filed in the Orleans Parish Civil District Court, <br />
