Ethics Board Docket No. 2021-334 <br /> Page 8of12 <br /> Further,since Mr.Lewis had not been continuously employed with the charter school for at <br /> least one year prior to Mr. Martin becoming the Principal on June 1, 2018,he was not entitled to a <br /> normal promotional advancement when he was promoted to Athletic Director and Head Football <br /> Coach. Therefore, Mr. Lewis's promotion was prohibited. <br /> In addition,prior to Mr.Lewis being hired as a teacher,Mr.Martin participated in the hiring <br /> process by recommending Mr.Lewis for employment. Mr.Martin was prohibited from participating <br /> in any transaction, the hiring process, in which his immediate family member had a substantial <br /> economic interest. Therefore,Mr.Martin's participation in the hiring process was prohibited by the <br /> Code. <br /> If this matter proceeded to a public hearing before the Ethics Adjudicatory Board, and the <br /> Ethics Adjudicatory Board found a violation of the Code of Governmental Ethics, the Ethics <br /> Adjudicatory Board could impose a fine of up to $10,000 for each violation of the Code. In this <br /> particular situation, it is the conclusion of the Board that the interest of the public would be served <br /> by, and the parties have agreed to resolving this matter amicably through the publication of this <br /> Consent Opinion with the imposition of a$1,500 civil penalty against Darren Lewis and a$1,000 <br /> civil penalty against Derrell Martin. <br /> VI. <br /> ORDER: <br /> For the foregoing reasons: <br /> IT IS ORDERED that Darren Lewis,in his capacity as the Principal of the Walter Cohen <br /> College Prep Charter School,violated La. R.S.42:1119 by virtue of the employment of his sister's <br />
