Penalties for illegal gain; forfeiture of gifts, payments <br /> A. If an investigation conducted pursuant to this Part reveals that any public <br /> servant or other person has violated any law within the jurisdiction of the Board of <br /> Ethics to his economic advantage, and after an adjudicatory hearing on the matter, <br /> the Ethics Adjudicatory Board may order the payment of penalties. Recovery may <br /> include, in addition to an amount equal to such economic advantage, penalties not <br /> to exceed one half of the amount of the economic advantage. Any appeal of such <br /> final decision by the Ethics Adjudicatory Board shall be to the Court of Appeal, <br /> First Circuit,pursuant to R.S. 42:1142. <br /> V. <br /> OPINION: <br /> It is the opinion of the BOE that Brian Pope, in his capacity as City Marshal, City Court, <br /> City of Lafayette, Parish of Lafayette, violated Section I I I IA of the Ethics Code by virtue of <br /> receiving compensation from each of the City Court and the Marshal's Office which he was not <br /> duly entitled to receive for the performance of his job duties. Section 111 I of the Ethics Code <br /> prohibits the City Marshal from receiving for the performance of his duties any thing of economic <br /> value to which they are not duly entitled. <br /> Brian Pope, while serving as City Marshal, City Court, City of Lafayette, Parish of <br /> Lafayette, received supplemental compensation in excess of his set compensation. <br /> It is the opinion of the BOE that Brian Pope, in his capacity as City Marshal, City Court, <br /> City of Lafayette, Parish of Lafayette, violated Section I I 12 of the Ethics Code by virtue of <br /> instructing staff of the Marshal's Office to issue supplemental compensation checks to Mr. Pope. <br /> Section 1112A of the Ethics Code prohibits the City Marshal from participating in a transaction <br /> involving the Marshal's Office in which he has a substantial economic interest. <br />
