34 <br /> Ethics Board Docket No. 2017-1404 <br /> Page 8 of 10 <br /> Brian Pope, while serving as City Marshal, City Court, City of Lafayette, Parish of <br /> Lafayette, directed staff of the Marshal's Office to issue payments to Mr. Pope in which he had a <br /> substantial economic interest. <br /> If this matter proceeded to a public hearing before the Ethics Adjudicatory Board, and the <br /> Ethics Adjudicatory Board found a violation of the Ethics Code, the Ethics Adjudicatory Board <br /> could impose a fine of up to $10,000 for each violation of the Ethics Code, pursuant to Section <br /> 1153B of the Ethics Code. The Ethics Adjudicatory Board could also impose penalties equal to <br /> one-and-a-half times the amount of economic advantage gained,pursuant to Section 1155A of the <br /> Ethics Code. In this particular situation, it is the conclusion of the Board that the interest of the <br /> public would be served by, and the parties have agreed to resolving this matter amicably through <br /> the publication of this Consent Opinion with no imposition of a civil penalty against Mr. Pope. <br /> VI. <br /> ORDER: <br /> For the foregoing reasons: <br /> IT IS ORDERED that Brian Pope, in his capacity as City Marshal, City Court, City of <br /> Lafayette, Parish of Lafayette, violated Section 1111 A of the Ethics Code by virtue of receiving <br /> compensation from each of the City Court and the Marshal's Office which he was not duly entitled <br /> to receive for the performance of his job duties. <br /> IT IS FURTHER ORDERED that Brian Pope, in his capacity as City Marshal, City <br /> Court, City of Lafayette, Parish of Lafayette,violated Section 1112A of the Ethics Code by virtue <br /> of instructing staff of the Marshal's Office to issue supplemental compensation checks to Mr.Pope <br />
