i <br /> Ethics Board Docket Nos.2023-661 <br /> Page 7 of 11 <br /> (3) defines "agency head"means the chief executive or administrative officer of an <br /> agency or any member of a board or commission who exercises supervision over the <br /> agency. <br /> (4)defines"assist"means to act in such a way as to help,advise,furnish information <br /> to,or aid a person with the intent to assist such person. <br /> (16)defines"person"to mean an individual or legal entity other than a governmental <br /> entity, or an agency thereof. <br /> f <br /> 1 <br /> i <br /> 5. <br /> The following provisions proscribe the penalties the Ethics Adjudicatory Board may assess <br /> if the Ethics Adjudicatory Board determines a violation of the Code of Governmental Ethics has <br /> occurred: <br /> §1153. Penalties <br /> B. Upon a determination that any public employee or other person has violated any <br /> provision of any law within the jurisdiction of the Board of Ethics except violations <br /> of the Campaign Finance Disclosure Act which shall be governed by Chapter 11 of <br /> Title 18 of the Louisiana Revised Statutes of 1950, the Ethics Adjudicatory Board <br /> may remove, suspend, or order a reduction in pay, or demotion of the public <br /> j employee or other person,or impose a fine of not more than ten thousand dollars,or <br /> both. <br /> V. <br /> OPMON: <br /> It is the opinion of the Board that GEO Foundation violated La. R.S. 42:1117 by remitting <br /> payment to Robert McGarner by virtue of his employment with GEO Foundation and assistance to <br /> GEO Foundation in transactions with GEO Academies EBR within two years of the termination of <br /> his service as a member of the GEO Academies EBR Charter School Board,which was prohibited <br /> i <br /> i <br /> by La.
