Ethics Board Docket Nos. 2023-659
Page 8 of l l
its jurisdiction pursuant to the Charter School Contracts between GEO Academies EBR and the
Board of Elementary and Secondary Education.
GEO Foundation is a person as defined by La. R.S. 42:1102(16) as it is a private nonprofit
organization.
As an appointed member of a board or commission, Ms. Johnson was prohibited from
receiving a thing of economic value for services rendered to a person that has or was seeking to have
a contractual,or other business or financial relationship with her board. Therefore,Linda Johnson's
receipt of compensation for services rendered to GEO Foundation while GEO Foundation had
contractual, business and financial relationships with GEO Academies EBR and she was a member
of the GEO Academies EBR Board of Directors violated La. R.S. 42:1111C(2)(d).
If this matter proceeded to a public hearing before the Ethics Adjudicatory Board, and the
Ethics Adjudicatory Board found a violation of the Code of Governmental Ethics, the Ethics
Adjudicatory Board could impose a fine of up to $10,000 for each violation of the Code. Further,
an additional penalty in an amount not to exceed one and one half times of the economic advantage
could be assessed. In this particular situation,it is the conclusion of the Board that the interest of the
public would be served by,and the parties have agreed to resolving this matter amicably through the
publication of this Consent Opinion with the imposition of a $10,000 civil penalty against Linda
Johnson.
