Ethics Board Docket Nos. 2023-659 <br /> Page 8 of l l <br /> its jurisdiction pursuant to the Charter School Contracts between GEO Academies EBR and the <br /> Board of Elementary and Secondary Education. <br /> GEO Foundation is a person as defined by La. R.S. 42:1102(16) as it is a private nonprofit <br /> organization. <br /> As an appointed member of a board or commission, Ms. Johnson was prohibited from <br /> receiving a thing of economic value for services rendered to a person that has or was seeking to have <br /> a contractual,or other business or financial relationship with her board. Therefore,Linda Johnson's <br /> receipt of compensation for services rendered to GEO Foundation while GEO Foundation had <br /> contractual,business and financial relationships with GEO Academies EBR and she was a member <br /> of the GEO Academies EBR Board of Directors violated La. R.S. 42:1111C(2)(d). <br /> If this matter proceeded to a public hearing before the Ethics Adjudicatory Board, and the <br /> Ethics Adjudicatory Board found a violation of the Code of Governmental Ethics, the Ethics <br /> Adjudicatory Board could impose a fine of up to $10,000 for each violation of the Code. Further, <br /> an additional penalty in an amount not to exceed one and one half times of the economic advantage <br /> could be assessed. In this particular situation,it is the conclusion of the Board that the interest of the <br /> public would be served by,and the parties have agreed to resolving this matter amicably through the <br /> publication of this Consent Opinion with the imposition of a $10,000 civil penalty against Linda <br /> Johnson. <br />
