Ethics Board Docket No. 2020-876
No public servant or other person shall give, pay, loan, transfer, or deliver or offer
to give, pay, loan, transfer or deliver, directly or indirectly, to any public servant or
other person any thing of economic value which such public servant or other person
would be prohibited from receiving by any provision of this Part.
V.
OPINION:
It is the opinion of the BOE that State Line violated Section 1117 of the Ethics Code by
virtue of providing a thing of economic value to Justin Childress, a board member of the District,
for services rendered to State Line while State Line was seeking and had a business relationship
with the District.
Mr. Childress was an employee of State Line and received regular payroll compensation
from State Line for services as an employee during the time in which State Line and the District
were negotiating and consummating a sale of property from State Line to the District.
If this matter proceeded to a public hearing before the Ethics Adjudicatory Board, and the
Ethics Adjudicatory Board found a violation of the Code of Governmental Ethics, the Ethics
Adjudicatory Board could impose a fine of up to $10,000 for each violation of the Code. In this
particular situation, it is the conclusion of the BOE that the interest of the public would be served
by, and the parties have agreed to resolving this matter amicably through the publication of this
Consent Opinion with the imposition of a$500 civil penalty against State Line.
