remove, suspend, or order a reduction in pay, or demotion of the public employee or <br /> other person, or impose a fine of not more than ten thousand dollars, or both. <br /> V. <br /> OPINION: <br /> Precious Phillips was a public servant as defined by the Code during her employment at <br /> Judson Fundamental Elementary School of Caddo Parish School Board. Precious Phillips had <br /> certain duties and responsibilities while she was Cheer Sponsor during the two school terms she <br /> served as Cheer Sponsor (2018 to 2019 and 2019 to 2020). As such, Precious Phillips, was <br /> responsible for collecting annual monetary dues and conducting fundraisers for the cheer team. <br /> Precious Phillips improperly received compensation totaling $5,165.00 from five fundraisers and <br /> two school terms of cheerleader dues as Cheer Sponsor. <br /> It is the opinion of the BOE that Precious Phillips, in her capacity as Cheer Sponsor of the <br /> Winning Warriors Cheerleaders at Judson Fundamental Elementary School of Caddo Parish <br /> School Board, violated La. R.S. 42:1111(A)(1)(a) when she received $5,165.00 in compensation <br /> which she was not duly entitled to receive for the performance of her duties and responsibilities as <br /> Cheer Sponsor from 2018 to 2020. <br /> If this matter proceeded to a public hearing before the Ethics Adjudicatory Board("EAB"), <br /> and the EAB found a violation of the Code of Governmental Ethics, the EAB could impose a fine <br /> of$10,000 for each violation of the Code. In this particular situation, it is the conclusion of the <br /> Board that the interest of the public would be served by, and the parties have agreed to, resolving <br /> this matter amicably through the publication of this Consent Opinion with the imposition of a civil <br /> penalty in the amount of five-hundred dollars ($500) against Precious Phillips. <br /> Page 5 of 8 <br />
