Ethics Board Docket No. 2022-209 <br /> Page 3 of 9 <br /> 6. <br /> The Jeanerette Marshal's Policies and Procedures manual regarding overtime during <br /> 2019 and 2020 provided as follows: <br /> (a) "As departmental policy, overtime is to be discouraged and will only be paid if <br /> all efforts have been exhausted for Procedural Order 105, Section III." <br /> (b) "Eligibility for overtime pay shall be for Grades I through 9, Ward 3-Iberia <br /> Parish Marshal's Department." <br /> (c) "Management personnel (Grades 10 and above)are not eligible for overtime." <br /> 7. <br /> On July 25, 2019, as City Marshal, Fernest Martin claimed thirty-nine and a half(39.5) <br /> hours of overtime, which resulted in a payment of$1,007.25 of overtime pay. <br /> 8. <br /> Additionally, on October 16, 2020, as City Marshal, Fernest Martin claimed seven and a <br /> half(7.5) hours of overtime, which resulted in a payment of$191.25 of overtime pay. <br /> 9. <br /> Fernest Martin has reimbursed the City Marhsall's office for the overtime payments <br /> totaling $1,198.50. <br /> IV. <br /> PROVISIONS OF LAW: <br /> 10. <br /> La. R.S. 42:1111(A)(1)(a) provides that no public servant shall receive anything of <br /> economic value, other than the compensation and benefits from the governmental entity to which <br /> he is duly entitled, for the performance of the duties and responsibilities of his office or position. <br />
