IV. <br /> PROVISIONS OF LAW: <br /> 10. <br /> La. R.S. 42:1111(A)(1)(a) of the Code of Governmental Ethics prohibits a public servant from <br /> receiving anything of economic value, other than compensation and benefits from the <br /> governmental entity to which he is duly entitled, for the performance of the duties and <br /> responsibilities of his office or position. <br /> La. R.S. 42:1112(A) of the Code of Governmental Ethics prohibits a public servant from <br /> participating in a transaction in which he has a personal substantial economic interest of which he <br /> may be reasonably expected to know involving the governmental entity. <br /> La. R.S. 42:11112(12) defines a "governmental entity" as the state or any political subdivision <br /> which employs the public employee or employed the former public employee or to which the <br /> elected official is elected, as the case may be. <br /> La. R.S. 42:1102(15) defines "Participate" to mean to take part in or to have or share <br /> responsibility for action of a governmental entity or a proceeding, personally, as a public servant <br /> of the governmental entity, through approval, disapproval, decision, recommendation, the <br /> rendering of advice,investigation,or the failure to act or perform a duty. <br /> La. R.S. 42:1102(18)(a) of the code of Governmental ethics defines a "Public employee" as <br /> anyone.whether compensated or not, who is: <br /> (i) An administrative officer or official of a governmental entity who is not filling an <br /> elective office. <br /> La.
